Terms & Conditions
1. Scope and Definitions
These Terms and Conditions (T&C) apply to the business relationship between Listing Analyse Mike Hammel, Alfred-Weitnauer-Str. 15, 87439 Kempten (hereinafter referred to as the "PROVIDER") and the user of the analysis tool (hereinafter referred to as the "CUSTOMER").
The PROVIDER offers an online tool for analyzing listings on short-term rental platforms such as Airbnb.
The offer is intended exclusively for entrepreneurs as defined in Section 14 of the German Civil Code (BGB).
Deviating terms and conditions of the CUSTOMER shall not apply unless expressly agreed to by the PROVIDER.
The contractual basis is derived from the individual order of the analysis product by the CUSTOMER and these T&C. The version valid at the time the contract is concluded shall apply.
2. Services
The PROVIDER offers the CUSTOMER a web-based tool for analyzing online listings (e.g., on Airbnb) with regard to their quality and potential for optimization. The scope of services depends on the selected package. The PROVIDER offers four package options:
Power Guide – A practical handbook full of insider tips to increase bookings, improve Airbnb SEO, achieve better guest reviews, and more.
Listing Analysis – The CUSTOMER receives a detailed performance report for their Airbnb listing(s), including personalized recommendations, AI-optimized descriptions, keyword insights, and market data. The PROVIDER requires the Airbnb link of the listing to be analyzed from the CUSTOMER.
Process Guide – A practical manual to automate the hosting workflow, including pricing, guest communication, cleaning, and other automation hacks.
Ultimate – The PROVIDER takes over the complete digital optimization of the CUSTOMER's listing with custom implementations. For this package, the PROVIDER temporarily requires access to the CUSTOMER’s Airbnb account.
Depending on the selected package, services may be standardized and/or personalized.
A specific economic success (e.g., revenue increase) is not guaranteed.
The PROVIDER may engage third parties, including subcontractors, to fulfill individual or all contractual obligations.
3. Conclusion of Contract
The presentation of services on the website does not constitute a legally binding offer. A contract is only concluded when the CUSTOMER places an order and the PROVIDER confirms it.
The CUSTOMER expressly agrees not to share any materials or links accessed under this contract with third parties.
4. Fees
Use of the analysis tool is subject to a fee. The price listed at the time of contract conclusion plus VAT applies. Payment is due in advance.
The CUSTOMER will gain access to the services only after the PROVIDER has received payment.
5. Default
In the event of payment default, the PROVIDER is entitled to suspend access to the tool until the outstanding amount is paid.
6. Obligations of the PARTIES for the Provision of Services
All contractually agreed services shall be provided by the PROVIDER starting from the time of contract conclusion.
The CUSTOMER is responsible for the accuracy of the data entered (e.g., URL of the Airbnb listing).
The CUSTOMER agrees not to misuse the tool or its materials and not to share content with third parties.
The CUSTOMER must ensure that all technical requirements for using the analysis tool are met. This includes a stable and sufficiently powerful internet connection and a compatible device (e.g., PC, laptop, or smartphone).
The PROVIDER is not liable for limited usability of the service if it is due to insufficient technical requirements on the CUSTOMER's side.
If certain parts of the product (e.g., digital reports or content) are made available at specific times, it is the CUSTOMER’s responsibility to retrieve or access them in a timely manner. Short-term rescheduling or cancellation of such digital deliveries is only possible with prior written agreement from the PROVIDER.
The PROVIDER is entitled to provide all services – if applicable – exclusively in digital form, such as via email, download links, or digital platforms (e.g., Zoom, Google Drive, Google Meet, etc.).
7. Right of Use and Availability
The CUSTOMER is granted a simple, non-transferable right to use the analysis tool and the provided content for their own business purposes.
8. Liability
The PROVIDER is liable only for damages resulting from intentional or grossly negligent breach of duty, and for injury to life, body, or health. For simple negligence, the PROVIDER is liable only for breach of essential contractual obligations and limited to the typical foreseeable damage.
9. Payment Terms
Payment can be made via PayPal and Visa.
The PROVIDER is entitled to use third parties for payment processing. The CUSTOMER agrees that the PROVIDER is authorized to enter corresponding (payment) data on behalf of the CUSTOMER in this context.
Billing – in particular invoicing – is carried out exclusively electronically to the email address provided by the CUSTOMER. The CUSTOMER explicitly agrees to this. If the CUSTOMER requests an alternative delivery method, such as postal mail, they shall bear the additional costs.
10. Data Protection and Confidentiality
Personal data of the CUSTOMER is processed only in accordance with applicable legal provisions. Further information can be found in the privacy policy on the website.
11. Copyright
All content of the analysis tool and guides – especially texts, evaluations, diagrams, and recommendations – is protected by copyright. Duplication or distribution to third parties is not permitted without the PROVIDER’s written consent.
12. Withdrawal
The contract is exclusively aimed at entrepreneurs (within the meaning of § 14 BGB), and therefore no statutory right of withdrawal applies.
13. Reference Naming
The PROVIDER is entitled to name the CUSTOMER as a reference unless the CUSTOMER objects.
14. Final Provisions
Place of performance and jurisdiction is the PROVIDER’s registered office. German law applies.
If any individual provision is invalid, the validity of the remaining provisions shall remain unaffected.
